しかし、原告側は、「都の土壌汚染対策は極めてずさんで不十分。現に移転予定地に存在する有害物質を確実に除去できない。土壌汚染対策を再検証することなく、市場の移転が行われたなら、有害物質によって、市場で働く業者の生命身体が害される可能性が極めて高い。都が、客観的な再検証可能な唯一の証拠物を廃棄することはあってはならない」と主張している。
